Judge Rodney Smith, however, ruled that Apple’s claims are “baffling, if not false.” He wrote in his judgment (via TechCrunch): “Weighing all the necessary factors, the Court finds that Corellium has faced its burden of establishing fair use. Therefore, its use of iOS in connection with the Corellium product is permitted. “The judge also pointed out that Apple sought to acquire Corellium in 2018 and was able to test its product before their talks failed. If Apple had pursued the acquisition of Corellium, the latter’s software would be. apparently used for internal testing and validation.The ruling discussed how Corellium checks its customers before even selling the software to them.
