A six-year class lawsuit against Apple and the iPhone 4S has been decided. The lawsuit alleges Apple deliberately slowed down the device following the iOS 9 update in 2015. The company agreed to pay $ 15 in compensation to some iPhone 4S owners who experienced poor performance. The class action suit was first filed in December 2015, with plaintiffs representing a group of iPhone 4S customers from New York and New Jersey. The Cupertino Company has been accused of selling fake iOS 9 update products in the lawsuit. This update is said to improve performance on supported devices, including the iPhone 4S.
The action-class outfit argues that the iOS 9 update on the iPhone 4S reduced the performance of the device. This is contrary to what Apple has promised in its marketing. iOS unveiled a sales tagline from Apple that says, “The most advanced mobile experience. Now even more. ”In addition, the update includes Siri activation tips, Move on, Shared View, Picture in Picture on iPad as well as a host of additional features. For the iPhone, Apple promised, “under-hood updates [that] bring more responsive work for you. ”
Also, the court-action class argues these recommendations are a false sale in terms of the iPhone 4S. The device being the oldest in terms of iPhone iOS 9 support. The decision sees Apple distributing $ 20 million in compensation to iPhone 4S owners in New York and New Jersey. Residents in these states who experience poor performance after the iOS 9 update may receive compensation. Users who believe they deserve $ 15 must, “submit a notice under penalty of perjury that, to the best of their knowledge, they have released iOS 9, or any version, of it, on their iPhone 4s. . . Their iPhone 4S experienced a significant reduction in performance as a result, entitled to a payment of $ 15 per applicable device ”.
Finally, a website will be available for customers who believe they are entitled to a decision. In addition, customers will be able to submit a form providing their email address, iPhone 4S serial number (if possible) and mailing address.
