Apple's request of a new trial on a VirnetX patent case rejected by a judge

Apple's request for a new trial for an endless court struggle with VirnetX has been denied. Apple was seeking a new trial as part of a patent battle, but you can not get a trial, but there is still a possibility of appeal.

Reported AppleInsiderA judgment was made by Robert Schroeder, judge of the District Court for the Eastern District of Texas. In its final ruling, Mr. Schroeder denied a lawsuit seeking a new trial by Apple, "partially rejected and dismissed VirnetX judgment litigation and fair and statutory remedy litigation".

At this time, because the document is sealed, details are unknown, but Schroder terminated the case by giving the final judgment, but this will not stop the appeal to the High Court.

The battle between Apple and VirnetX is far behind this year. In 2012, Apple missed a suit of $ 368.2 million from VirnetX, but the ruling was abandoned and paved the way for retrialing and additional conflicts.

Earlier this year Apple was convicted of infringing four VirnetX patents and ordered damages of $ 520.6 million. The patents in question are related to Apple's FaceTime, VPN, and iMessage services. In another case, Apple was convicted of patent infringement, damages to VirnetX amounted to $ 433.7 million. Apple is complaining of such a case.

Apple is likely to appeal this ruling to the upper courts too. Among cases, Apple is seeking damages of more than $ 1 billion on VirnetX.
